Frequently Asked Questions

What types of commercial disputes does Litigon handle?

Litigon focuses on commercial disputes between businesses and individuals, including contract disagreements, debt recovery matters, shareholder conflicts, and professional liability claims. We work primarily within the civil jurisdiction of the Malaysian courts and with approved arbitral and mediation bodies in Malaysia. During an initial consultation, we will assess whether your matter falls within our practice areas and advise you on the most appropriate next steps.

How long does litigation typically take in the Malaysian court system?

The duration of court proceedings in Malaysia varies considerably depending on the complexity of the matter, the court in which it is filed, and the parties' conduct throughout the process. A straightforward civil claim may resolve within twelve to eighteen months, while more complex commercial disputes can take two to four years through to a full trial. Appellate proceedings before the Court of Appeal or Federal Court add further time, governed by court scheduling and procedural rules. We will provide a realistic timeline assessment at the outset of each engagement.

What is the difference between mediation, adjudication, and arbitration?

Mediation is a facilitated negotiation process where a neutral mediator helps parties reach a mutually acceptable settlement — the mediator does not impose a decision. Adjudication is a faster, binding decision-making process commonly used in construction and related disputes in Malaysia. Arbitration involves a neutral arbitrator or panel who hears both sides and issues a binding award, similar in effect to a court judgment but conducted privately and often more flexibly. The most suitable process depends on your contract terms, the nature of the dispute, and your priorities regarding speed, confidentiality, and finality.

How are professional fees structured at Litigon?

Our fees are structured around the nature and scope of each engagement. Litigation Strategy sessions are priced from MYR 6,900, Alternative Dispute Resolution services from MYR 4,300, and Appellate Advocacy from MYR 8,200. These starting figures reflect the initial scope of work; more complex or extended matters are discussed and agreed upon transparently before engagement. We provide clear fee estimates at the consultation stage so that you can make informed decisions about how to proceed.

What should I prepare before an initial strategy session?

The more context you can share, the more productive the session will be. Helpful materials include any relevant contracts or agreements, correspondence between the parties, any documents that set out the dispute or claims, and a brief timeline of key events. If there are existing court documents or prior legal opinions, please bring those as well. You are not expected to have everything organised perfectly — we will work through the material together and identify what additional information may be needed.

Can Litigon assist with matters outside of Kuala Lumpur?

Yes. While our office is based in Kuala Lumpur, we handle matters across Malaysian jurisdictions and regularly advise clients who are located in other states. Many preliminary consultations and strategy sessions can be conducted remotely. For court appearances outside Kuala Lumpur, we will discuss the most practical arrangements with you at the outset. Our primary focus remains commercial disputes within the Malaysian legal framework.
